1) Who we are
Helperfy.ai is a service provided by Engipulse (the “Company”, “we”, “us”, “our”). Legal entity: ENGIPULSE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOSCIĄ, address: 16/138 Czyżówka str., Kraków, Poland. Legal and Privacy inquiries: dpo@engipulse.com.
2) Acceptance of these Terms
By accessing or using helperfy.ai, you agree to these Terms of Use, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Services.
3) Services
We provide a platform and tools to create, configure, and use AI bots for various needs, including integrations with third-party AI providers (e.g., OpenAI, Google, etc.), depending on your plan and privacy settings.
4) Accounts & Age
You must provide accurate information and keep your credentials secure.
Minimum age: 16 (or higher if required by your local law). If you are under 18, parental/guardian consent may be required where applicable.
You are responsible for all activity under your account.
5) Plans, Billing & Auto-Renewal
We offer free and paid subscriptions (monthly/annual) and, where applicable, usage-based billing (tokens/requests).
Charges are billed in advance; subscriptions auto-renew unless canceled before the renewal date in your account settings.
Taxes may apply.
Cancellation and refunds are governed by our Refund Policy.
6) Acceptable Use (AUP)
You agree not to:
- violate laws, third-party IP, or privacy rights;
- upload/generate illegal, discriminatory, harmful, or dangerous content;
- attempt to circumvent limits, reverse-engineer, or attack our infrastructure;
- collect or transfer personal data without a proper legal basis/consent;
- use the Services for spam or unsolicited bulk communications;
- deploy for high-risk uses without appropriate human oversight and safeguards (see §10).
7) User Content & IP
Your Content remains yours. You grant us a limited license to process it to provide and support the Services (request handling, history/storage you enable, logging, security) and to improve the Services only with your explicit consent or where enabled by your plan/privacy settings.
We do not claim rights in your trademarks.
Our IP/Platform. All rights in the platform, models, code, and branding belong to Engipulse or its licensors. You may not copy or create derivative works without permission.
Feedback. If you share feedback, we may use it without obligation to compensate you.
8) AI Routing & Privacy Modes
We minimize data sharing by design and offer modes:
Private: processing in a private/isolated environment; data is not used to train public models.
Hybrid: some requests may be routed to vetted providers (e.g., OpenAI, Google) for inference; by default, without provider training unless you opt in.
Public/Community (if available in your plan): You explicitly consent that certain requests/content may be used by providers to improve their models.
Available modes depend on your plan and privacy settings. Details in the Privacy Policy and in your account controls.
We do not sell personal data. Contact information submitted for demos/support is used solely to communicate with those users about their request.
9) Compliance & Security
Engipulse holds ISO 27001 certification; we comply with GDPR and are committed to EU AI Act compliance within our controller/processor roles.
We implement technical and organizational measures (in-transit encryption, access controls, segmentation, auditing). No method is 100% secure.
10) AI Output & Human Oversight
Generated content can be inaccurate, biased, or outdated. You must verify outputs and should not rely on them as professional advice (medical, legal, financial, etc.) without qualified human review.
11) Third Parties & Integrations
The Services may link to or integrate with third-party services/APIs subject to their terms. We are not responsible for their content or practices.
12) Suspension & Termination
We may suspend or terminate access for violations of these Terms or security risks. You may close your account at any time via settings.
13) Disclaimers
The Services are provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by law.
14) Limitation of Liability
To the extent permitted by law, our aggregate liability is limited to the amounts you paid for the Services in the 12 months preceding the event. We are not liable for indirect, consequential, or special damages or lost profits.
15) Indemnification
You agree to indemnify and hold us harmless from losses/costs arising out of your breach of these Terms or misuse of the Services.
16) Governing Law & Disputes
These Terms are governed by the laws of Poland, excluding conflict-of-law rules. The Polish courts have exclusive jurisdiction unless mandatory consumer protections in your EU country apply.
17) Changes to these Terms
We may update these Terms; material changes will be notified via this website or email. Continued use of our website, products and services means acceptance of the changes.
